Overview

Mark Henkle focuses his practice on environmental and product regulation law. He has experience in handling a wide variety of matters representing corporations as well as individuals in the areas in both state and federal courts.

Prior to joining the firm, Mark was an associate in the Charlotte, North Carolina office of a southeast regional general civil trial law firm where he litigated personal injury, property damage, premises liability, wrongful death, and employment investigations and claims. Previously, Mark was an attorney in the Charlotte office of a Carolina-based boutique insurance defense law firm where he litigated complex construction, personal injury, products liability, and employment cases.

While attending law school, Mark was an active member of the Moot Court Program, winning the award for “Best Brief”, and later serving on the Elon Law Moot Court Board.

Experience

*Represented a plaintiff political party and its candidates against the State of NC for 42 U.S.C. § 1983 violations of First Amendment and associational rights of candidates and the party. Obtained relief to put candidates and party on the ballot for the 2018 general election.

*Represented an elderly plaintiff in an ADEA discrimination and EEPA wrongful discharge action against an employer who was a regional administrator for the federal Head Start program. Case presented unique questions of law and litigation strategy due to the passage of House Bill 2 and its impact on EEPA wrongful discharge actions. Litigated case to successful resolution and settlement.

*Litigated construction defect case and underlying substantive issues under doctrines of res judicata and collateral estoppel to lead to successful and significantly reduced settlement of all claims for defendant subcontractor client.

*Defended an extensive property damage matter to a resolution whereby plaintiff insurance company admitted that electrical contractor client was not negligent as previously alleged in the Complaint. Matter involved significant motions practice, forensic evidence analysis, and deposition testimony.

*Defended manufacturer in a products liability matter to resolution at mediation whereby plaintiff had been significantly injured by product which had been recalled by the manufacturer for the issues alleged in the litigation.

*Defended business in multi-party premises liability case where court granted summary judgment in favor of business on all Plaintiff’s claims.

*Experience gained by attorney prior to joining Kilpatrick Townsend
