Insights: Events Two Years of Federal Circuit Review of PTAB Proceedings: What We Know and Still Don't Know

Two years have passed since the first Federal Circuit appeal from a PTAB inter partes review proceeding, In re Cuozzo, was decided in February 2015. During this time we have learned a great deal from the Federal Circuit's decisions, including the rate of affirmance and the types of appeals that the Federal Circuit vacates or reverses. This program will provide an overview of the Federal Circuit's decisions in IPR appeals to date. It will provide statistics as well as a detailed discussion of various topics including developments in claim construction, motions to amend practice, and the Federal Circuit's deferential posture toward the PTAB. The program will also discuss issues that have not yet been resolved or will be resolved en banc, including the issues raised by the Wi-Fi One and In re Aqua Products cases. This program will provide practitioners with valuable insights on the hot issues in this area.
