Kilpatrick Townsend’s Class Action Defense Team, part of the firm’s Complex Commercial Litigation Team, engages in a nationwide class action defense practice. The Team represents some of the largest corporations throughout the United States in federal court, state court, and arbitration proceedings. Our practice encompasses all aspects of effective class action defense—from the implementation of risk management strategies before a class action has been filed, such as drafting compulsory arbitration clauses and other effective consumer-facing terms and conditions—through creative and aggressive litigation strategies, such as contesting liability early in a case, pursuing an early settlement strategy, or developing novel arguments to defeat class certification. We know what it takes to effectively and efficiently deal with this kind of litigation. Our demonstrated litigation skills placed the firm in the National Tier 1 for Commercial Litigation by U.S. News - Best Lawyers® 2022 “Best Law Firms” rankings. In the pro bono area, the Class Action Team has represented plaintiffs in groundbreaking prison reform litigation.
