Overview

Brittany Herbert focuses her practice on complex commercial litigation in federal and state court, including breach of contract disputes, class actions, complex tort claims, directors and officers litigation, and insurance coverage.

Brittany represents private and public companies in a range of industries that comprise of, among others, telecommunications, construction, technology, and retail. She has defended and prosecuted disputes arising out of master purchase and service agreements, asset purchase agreements, software license agreements, franchise agreements, and covenants restricting competition and solicitation. In addition to contract-based disputes, Brittany’s practice encompasses complex tort claims involving fraud, tortious interference, and breach of fiduciary duties. Brittany also has experience litigating shareholder disputes and claims against directors and officers.

Previously, Brittany served as a judicial law clerk for Judge Brian A. Jackson in the U.S. District Court for the Middle District of Louisiana and as a judicial law clerk for Chief Magistrate Judge Karen Wells Roby in the U.S. District Court for the Eastern District of Louisiana.

While attending law school, Brittany was on the Michigan Journal of Race and Law and was Chair of the Black Law Students Association.

After graduating from Spelman College, Brittany served as a Fulbright Grantee in Yilan, Taiwan and taught Pre-Kindergarten as a Teach for America corps member.

Brittany was recognized in 2022 and 2023 as one of the "Best Lawyers: Ones to Watch" for Commercial Litigation by The Best Lawyers in America®.
