Served as national co-counsel for Flagstar Bank and Fannie Mae in proceedings before the United States District Court for the Western District of Virginia and before the Fourth Circuit Court of Appeals. The complaint challenging a foreclosure sale and alleged violations of Virginia Consumer Protection Act. The defense removed the case and obtained dismissal of the action in the district court, and the Fourth Circuit affirmed. The Fourth Circuit specifically held that the substitute trustee was fraudulently joined, such that its citizenship would not be considered in determining whether federal courts had diversity jurisdiction. McFadden v. Fed. Nat. Mortgage Ass'n, 525 F. App'x 223 (4th Cir. 2013).
